Terms of service

1. The service

KimonRecruit is an applicant tracking and skills assessment platform. It generates CV-personalised assessments and presents results as decision support for human reviewers. The platform does not make hiring decisions; the employers who use it do, and they remain responsible for those decisions and for complying with the employment and equality law that applies to them.

2. Accounts

• You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
• Employer workspaces are administered by the employer. Seat limits per subscription tier are described on the pricing page.
• Candidates use the platform free of charge and additionally benefit from the candidate transparency commitments described in our privacy policy.

3. Subscriptions and billing

• Paid tiers are billed monthly in pounds sterling, exclusive of VAT, which is added where applicable. Current prices are published on the pricing page.
• You may upgrade, downgrade or cancel at any time. Changes take effect at the next billing date; cancelled subscriptions remain active until the end of the period already paid for.
• There are no annual lock-ins, no cancellation fees and no hidden add-ons.

4. Acceptable use

You must not use the platform to:

• run hiring processes that contravene the Equality Act 2010, the EU AI Act or other applicable employment, equality or data protection law;
• treat assessment output as a sole automated basis for taking a candidate out of a process, which the platform is deliberately designed not to support;
• probe, scrape, overload or attempt to access another tenant's data; tenant isolation is enforced at the database layer and attempts to defeat it are grounds for immediate termination;
• upload content that is unlawful, infringing or malicious.

5. Data protection

Our privacy policy explains what we process and why, and our sub-processor list is published and kept current. For employer workspaces we act as a processor under a data processing agreement; EU and UK tenant data is processed and stored in the EU.

6. Intellectual property

We own the platform, including generated assessment structures, scoring methodology and software. You own your data: job postings, candidate records you control, and content you upload. You grant us the licence needed to operate the service on your behalf, and you can export your data at any time on every tier.

7. Service availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may improve or modify features over time; where a change materially reduces the service you pay for, we will tell you in advance and you may cancel before it takes effect.

8. Liability

Nothing in these terms excludes liability that cannot be excluded under English law. Subject to that, the platform is provided on an "as is" basis, our total liability in any twelve-month period is limited to the fees you paid us in that period, and we are not liable for hiring decisions, which remain the employer's own.

9. Termination

You can stop using the service and delete your workspace at any time. We may suspend or terminate accounts that breach these terms, with notice where practicable. On termination we delete or return personal data in line with the data processing agreement and our published retention schedule.

10. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where mandatory consumer or employment law in your country provides otherwise.
